Terms and conditions for Dutch Barks

Article 1: Definitions
1.1 Service Provider: Any representative or employee of Dutch Barks, referred to as “we,” “us,” or “our” throughout these terms.
1.2 Dog Owner: The individual who owns the dog(s) and enters into a service agreement.
1.3 Agreement: The arrangement between the dog owner and us for dog walking or boarding services.
1.4 Dog(s): The animal(s) owned by the dog owner and cared for or walked by us.
Article 2: General Provisions
2.1 These terms and conditions apply to all agreements between the dog owner and Dutch Barks. Any modifications must be provided in writing and signed by both parties.
2.2 We reserve the right to update our terms, conditions, and fees at any time.
2.3 We may refuse service if a dog demonstrates problematic behavior
2.4 Dogs must be well-socialized and safe around people and other dogs.
Article 3: Dog Health Requirements
3.1 Dogs must have up-to-date vaccinations, including annual boosters and protection against kennel cough. A valid vaccination certificate must be presented upon request.
3.2 Dog owners are responsible for ensuring their dogs are free from parasites, such as fleas, ticks, lice, or worms. We are not liable for infestations as outlined in Article 6.
3.3 Dog owners must inform us of any illnesses, injuries, or medical conditions prior to the start of services.
3.4 In case of a medical emergency, we are authorized to seek veterinary care at the dog owner’s expense. Dog owners will be notified as soon as possible.
Article 4: Dog Owner Responsibilities
4.1 By law, the dog owner is responsible for any damages caused by their dog. Dogs must be covered under the owner’s liability insurance, and proof of coverage may be requested.
4.2 Dog owners must provide accurate and complete information on our Dog Registration Form. Inaccuracies may result in liability for damages.
4.3 Dogs must be made available at the agreed-upon location, date, and time. If a dog is unavailable without at least 3 days notice, the full fee will still apply.
4.4 Dog owners must ensure we have safe access to their premises for the collection and return of their dog(s).
4.5 A towel must be provided to clean the dog if necessary. We are not liable for any damage caused by a wet or dirty dog.
4.6 Dog owners must ensure that their dog has access to sufficient drinking water at home.
Article 5: Service Provider Responsibilities
5.1 We will care for and handle all dogs with diligence and affection.
5.2 Group walks will typically last one hour, though they may be shortened due to extreme weather conditions (e.g., temperatures below 0°C, above 25°C, or heavy rainstorms).
5.3 We will provide updates on the dog’s health and behavior during care.
5.4 Dogs that develop behavior unsuitable for group walks may be excluded from such services.
5.5 Keys provided to us will be securely handled and used only for dog-related services. No address information will be stored with the key.
5.6 We may temporarily suspend services due to illness, holidays, or unforeseen circumstances. Clients will be notified promptly, and no charges will apply for missed sessions in such cases.
Article 6: Liability
6.1 Dog owners are responsible for damages caused by their dog to us, third parties, or property.
6.2 Medical costs or damages to third parties due to a dog’s actions are the sole responsibility of the dog owner. If the responsible dog cannot be identified, costs may be divided among the involved parties.
6.3 We are not liable for injuries, illnesses, or incidents involving the dog unless directly caused by gross negligence or intentional misconduct.
6.4 In the case of unforeseen circumstances (e.g., illness or emergency), we will notify the dog owner promptly but are not liable for any resulting inconvenience.
6.5 We are not liable if a dog escapes during care, though every effort will be made to recover the dog promptly.
6.6 Any liability claims against us will be limited to the total value of the affected service(s).
6.7 We are not responsible for parasite infestations contracted during care or walks.
Article 7: Cancellation Policy
7.1 Dog Walking Services:
- Cancellations for scheduled dog walking services must be made at least 24 hours in advance to avoid being charged the full fee.
- Cancellations made less than 24 hours before the service will be charged at 100% of the agreed fee.
7.2 Boarding Services:
- Cancellations made more than 7 days before the scheduled booking will incur no fee.
- Cancellations made less than 7 days before the scheduled booking will be charged 50% of the total booking fee.
7.3 This policy ensures that we can effectively manage availability and provide the best care for all our guests. Thank you for your understanding.
7.4 All cancellations must be communicated via phone, email, or text message and acknowledged by us to be valid.
